AquariumDepot.com — General Terms and Conditions
By accessing or using the AquariumDepot.com website (“Site”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must discontinue use of the Site immediately.
AquariumDepot.com reserves the right to revise these Terms at any time without prior notice. Continued use of the Site constitutes acceptance of any updated Terms.
1. Eligibility and Account Responsibility
By using the Site, placing an order, or creating an account, you represent that you are at least eighteen (18) years of age or are accessing the Site under the supervision of a parent or legal guardian. You further represent that you are legally able to enter into binding contracts.
AquariumDepot.com may assign you a password and account identification to enable access to certain portions of the Site. Each use of your credentials will be deemed authorized, and AquariumDepot.com is under no obligation to investigate the authorization or source of such access.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.
2. Right to Refuse Service
AquariumDepot.com reserves the right, in its sole discretion, to refuse service, cancel orders, restrict access, or close customer accounts at any time, with or without cause.
3. Accuracy of Information and Pricing Errors
Products may occasionally be listed with incorrect pricing or inaccurate descriptions due to typographical errors or incorrect supplier data. AquariumDepot.com reserves the right to refuse or cancel any orders placed for products listed at an incorrect price or with incorrect information.
If your payment method has already been charged and your order is canceled, AquariumDepot.com will issue a credit to the same method in the amount charged.
4. Special Offers, Discounts, and Free Items
All promotional offers, discounts, coupons, and free items are provided at the discretion of AquariumDepot.com. Unless explicitly stated otherwise, promotions are limited to one (1) offer per shipped order.
5. Product Images and Representation
Unless stated otherwise, product images are representative examples. Amphipods, phytoplankton, algae sheets, and flake foods vary naturally in appearance, density, and coloration. Variability is expected and normal.
6. Customer Information Accuracy
Customers are responsible for providing accurate shipping and contact information. AquariumDepot.com is not responsible for delays, losses, or delivery failures resulting from incorrect, outdated, or incomplete addresses or telephone numbers.
Errors introduced through third-party payment systems such as PayPal are also the responsibility of the customer.
7. Shipping Policies
All shipments are subject to the shipping policies posted on AquariumDepot.com. Live amphipods may require specific handling to ensure timely delivery. Packaging, timing, and carrier selection are at the discretion of AquariumDepot.com.
AquariumDepot.com is not responsible for carrier delays, weather impacts, missed deliveries, or failure to retrieve packages promptly.
8. Responsibility After Delivery
Once products have arrived in live or usable condition, AquariumDepot.com is not responsible for handling, storage, acclimation, tank conditions, water parameters, feeding, perishability, or any losses resulting from customer use.
9. Live Arrival Guarantee
AquariumDepot.com guarantees that live amphipods will arrive alive at the time of delivery. This guarantee applies exclusively to live amphipods and does not extend to phytoplankton, algae sheets, or flake foods.
9.1 Reporting Requirements
Claims of DOA amphipods must be submitted within twelve (12) hours of the carrier’s recorded delivery time and must include:
- Order number
- A clear photo of the unopened bag
- A clear photo of the contents
Claims that do not include the required documentation may not be eligible for review under this guarantee.
9.2 Remedy
Verified DOA claims receive store credit for the product cost only. Store credit is applied to the customer’s AquariumDepot.com account and may be used toward a future purchase.
9.3 Exclusions
This guarantee does not apply to amphipods after the point of delivery or once they leave the original shipping container. Losses due to tank conditions, acclimation practices, salinity, temperature, or introduction into freshwater systems are not covered.
10. Biomass and Count Disclosure (Live Amphipods)
All amphipods are portioned and packaged based on biomass, not individual organism count. Any count ranges listed on product pages are estimates and are not guaranteed.
10.1 Natural Variability in Amphipod Maturation
Amphipods naturally vary in size, maturity stage, and density. Portions may include a mixture of juvenile and adult amphipods, which affects visual count but not biomass.
10.2 Count Verification
Because amphipods move, cluster, and vary in size, visual inspection cannot reliably determine quantity. AquariumDepot.com does not evaluate claims based solely on perceived count but ensures all portions are packed to correct biomass specifications.
11. Freshwater Use & Limitations
Amphipods are marine organisms and are not expected to survive long-term in freshwater environments. They may remain active for a short period but will naturally experience a reduced lifespan. This reduced lifespan is normal and expected.
Amphipods are suitable for use as a high-protein live food source for freshwater fish. No guarantee applies once amphipods are introduced into freshwater.
12. Investigation Rights
AquariumDepot.com may request additional documentation when reviewing claims, including photos, videos, or delivery confirmation. All related costs are the responsibility of the customer. Failure to provide requested information may result in claim denial.
13. Repeated Claims and Account Review
AquariumDepot.com reserves the right to limit, suspend, or close customer accounts exhibiting repeated claims, patterns of misuse, or behavior deemed unreasonable or fraudulent.
14. Limitation of Liability
To the fullest extent permitted by law, AquariumDepot.com shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the purchase, handling, storage, or use of any product.
15. Indemnification
You agree to indemnify and hold harmless AquariumDepot.com, its owners, employees, and affiliates from any claims, liabilities, or expenses arising from your use of the Site or products.
16. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in courts located within the State of Florida.
17. Severability
If any portion of these Terms is found unenforceable, the remaining sections remain in full force.
18. Entire Agreement
These Terms constitute the entire agreement between you and AquariumDepot.com regarding the use of the Site and purchase of products.
